Crafting Outcomes-Based Contracts That Work for Everyone

More districts are borrowing a page from other industry playbooks to hold vendors accountable: using outcomes-based contracts as they seek outside help to propel students’ academic recovery.

Districts have set measurable student performance goals in contracts with tutoring providers, imposing penalties if the vendors fall short and awarding incentives if they exceed expectations. School systems are also trying out outcomes-based contracts for professional development.

Their use is still in its early stages, but district leaders and vendors in such arrangements say they’re more engaged with each other as they work toward mutual goals, and district leaders say the arrangements allow them to make more informed decisions on contract renewals. Still, the contracts require hands-on management, and some vendors might decide against signing outcomes-based contracts.

Brittany Miller serves as the managing director for the Center for Outcomes Based Contracting at the Southern Education Foundation. In this role, she oversees the learning and coaching with school district leaders to develop an RFP and subsequent contract where a minimum of 40% of the payment to the vendor is contingent on agreed-upon student outcomes. Most recently, Brittany led as senior director of Expanded Academic Learning for Denver Public 69´«Ă˝ (DPS) during the pilot for Outcomes Based Contracting. She has also taught in Denver and Arizona. She is deeply committed to promoting equity and considering community and school context in strategy development.
